2. Acceptance of these Terms

By accessing www.guidemybreak.com you confirm that you are at least 16 years old or have the consent of a parent or guardian and that you agree to be legally bound by these Terms. Our service is not directed at children under 13 and we apply the ICO’s Age-Appropriate Design Code when designing user journeys.

3. Changes to the Terms

We may update these Terms to reflect changes in the law (for example, the Online Safety Act) or our business practices. Where changes are material we will notify you by updating the “Effective date” below and, if you have subscribed, by email. Your continued use of the site after the effective date constitutes acceptance.

4. Using our website

4.1 Licence

We grant you a revocable, non-exclusive, non-transferable licence to access the site for personal, non-commercial use. All text, graphics, logos and code are protected under the Copyright, Designs and Patents Act 1988.

4.2 Prohibited conduct

You must not:

  1. Attempt to gain unauthorised access, interfere with, damage or disrupt any part of the site or the server on which it is stored (behaviour prohibited under the Computer Misuse Act 1990).

  2. Use the site in any way that is unlawful, fraudulent, defamatory or otherwise harmful, or that infringes any third-party rights (note the Defamation Act 2013 defence for operators only applies when specific notice procedures are followed). 

  3. Circumvent, remove or alter any copyright, trademark or other proprietary notices.

Breaching this clause may result in immediate termination of your licence to use the site.

5. Newsletter sign-up

Supplying your email is voluntary and governed by our Privacy Policy. You warrant that any email address you provide belongs to you and is accurate. You may unsubscribe at any time via the link in every message.

6. Third-party links

We may link to external sites for your convenience. We do not control those sites, provide no warranties regarding them and accept no liability for loss or damage arising from your use of them. Reasonable disclaimers of this kind are generally enforceable under UK unfair-contract-terms guidance so long as they are clear and prominent.

8. Disclaimers

The site is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, except those that cannot lawfully be excluded. 

We do not warrant that the site will be uninterrupted or error-free, or that it is free from viruses or other harmful components. Nothing on the site constitutes professional advice.

9. Limitation of liability

  1. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded under section 62 of the Consumer Rights Act 2015. 

  2. Subject to paragraph 1, we will not be liable for:

    • loss of profits, sales, business or revenue;

    • business interruption;

    • loss of anticipated savings;

    • loss of data; or

    • any indirect or consequential loss or damage.

  3. Our total liability arising out of or in connection with your use of the site will in no case exceed £100.

The above allocation of risk has been taken into account in setting the price—free—of access to the site and is considered fair under the CMA’s consumer-fairness guidance. 

10. Indemnity

You agree to indemnify and hold us, our directors and employees harmless from any claim or demand (including reasonable legal fees) arising out of your breach of these Terms or your violation of any law or third-party right.

11. Governing law & jurisdiction

These Terms, their subject matter and formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction to resolve any dispute arising from or related to them. 

12. Severability

If any provision of these Terms is held by a court to be unlawful, void or unenforceable, that provision will be deemed severed and will not affect the validity of the remaining provisions.

13. Entire agreement

These Terms (together with our Privacy Policy) constitute the entire agreement between you and us regarding the site and supersede any prior understandings.
